Reviewing New Zealands Constitution


Critics claim radical changes to the way we are governed and to the role of the Treaty could be on the way, as our constitution is quietly reviewed.

New Zealand’s constitution is under review, which may come as a revelation to those who didn’t know we had a constitution in the first place. It has also come as a surprise to many people who do know about our constitution and say that it works pretty well as it is, so why tamper with it? The answer to that question lies in the political horse-trading that followed the 2008 general election. It’s hard to find anyone who argues that New Zealand’s constitutional arrangements are in urgent need of an overhaul, but a review was on the Maori Party’s shopping list when it entered coalition negotiations with National. Under the confidence and supply agreement that emerged from those talks, the Maori Party extracted a commitment that the Government would conduct a “wide-ranging” review of the constitution.
Announcing the terms of reference in December 2010, Deputy Prime Minister Bill English and Maori Affairs Minister Pita Sharples said the review would cover issues such as the size of Parliament, the length of the electoral term, Maori representation, the role of the Treaty of Waitangi and whether New Zealand needs a written constitution. The review has come under fire for a variety of reasons, among them the notable omission of any reference to a republican option. But it’s those last two points that have created the most disquiet. Critics claim the review is working towards a predetermined outcome: namely, the creation of a written constitution with the Treaty, or its “principles”, entrenched as supreme law. Under such an arrangement, the critics argue, the Supreme Court would have the power to strike down any laws deemed inconsistent with the Treaty.
Constitutionalists point out that this would subvert the principle of parliamentary supremacy, which underpins our constitutional arrangements. Ultimate power would shift from the people’s elected representatives in Parliament to the judiciary. James Allan, a former legal academic at the University of Otago, now a professor of law at the University of Queensland, says a written constitution would be a disaster for New Zealand, and that he would “run a mile” from incorporating the Treaty into any such document – “not least because no one knows what it means when applied to any specific issue”. Inevitably, it would involve judges determining how the Treaty should be interpreted and applied.

GENERAL ALARM

What’s unusual about opposition to the review is that alarm bells are ringing right across the political spectrum. New Zealand First leader Winston Peters says a constitutional advisory panel appointed by the Government is stacked and the outcome already decided. “The so-called ‘principles’ of the Treaty will creep into all laws that shape our existence.” In particular, critics have seized on Sharples’s statement that the review will provide an opportunity to consider how New Zealand’s legal and political systems can reflect tikanga Maori, or Maori custom. Former Act MP Muriel Newman, who has launched a campaign against the review, says a Treaty-based constitution would enshrine Maori privilege and turn non-Maori New Zealanders into second-class citizens. “New Zealand would forever be locked into a future of separatism and racial division.”  ...click for more

A bombshell decision to end water fluoridation in New Plymouth is being heralded as the beginning of the end for the practice in New Zealand.
The New Plymouth District Council yesterday voted to stop fluoridation in the district after more than 40 years of adding the chemical to its water to reduce dental decay.
Mary Byrne of anti-fluoride group Fluoride Action Network New Zealand said the decision could lead to a domino effect of other councils rejecting the chemical.
"It has to because we have got New Plymouth and the Ruapehu District Council both deciding to turn it off.
"The other councils don't have a leg to stand on. What this does is legitimise it.
"It will give other councils the courage to make the right decision and it also makes a lot of them realise this is a serious mainstream issue," Ms Byrne said.
The decision was the biggest anti-fluoride victory so far, made more significant because councillors held a two-day tribunal to hear both sides of the argument before reaching their conclusion.
"I think what will happen is I think this New Plymouth decision will shake up the remaining councils.
"Because we now have 25 councils out of 69 that have fluoridation and they will start wondering if they are doing the right thing ... I definitely think this is the beginning of the end."
More than half of New Zealand's population supplied with fluoridated water – Christchurch is the only main centre with non-fluoridated water.
In rejecting fluoride, New Plymouth will join Tauranga, Whanganui, Rotorua, Whangarei, Timaru, Nelson, Napier and Greymouth as cities with non-fluoridated water....click link to read more...

Regionalization of resources by non-elected administrators

Local and regional efforts to control water hold that private water usage is causing salt water intrusion, polluted water, and supply shortages. A conglomeration of local and international government and non-government organizations insist that the solution to these problems is to monitor individual water usage under regionalized control. These groups are now in advanced stages of implementing programs that subjugate water use and citizen water rights to regional control by non-elected officials.
Consequences
While the stated end of creating a "sustainable" water system seems noble in intent, the means rely on subjugating constitutionally protected private property rights to non-elected bureaucrats. Their practices have already resulted in engineered crisis and a degraded environment. The ultimate consequences of political efforts to de-privatize water in the name of sustainable watershed will lead to manufactured shortages, inadequate water supplies for human needs, and will cause further damage to the local ecology.
Position
We object to having those whose policies created current water problems continue to further entrench their power base by presenting themselves as those who can solve the problems—while continuing to successfully place blame for the problems upon property owners, business people, farmers, sports enthusiasts, and those who have openly opposed their policies.
It is our position that:
* There is more than adequate water in Santa Cruz County to meet needs of humans, while supporting and enhancing the environment.
* That "sustainable" water policy is based on political objectives, not objective science.
* The further implementation of politically-motivated environmental policies will prevent proper storage and adequate use of water.
Objectives
* Educate the public about the cause of county water problems.
* Inform the public about practical long-term solutions to water problems that provide more than adequate water for community, farmer, and private property owner, while preserving and enhancing the ecology of Santa Cruz County.
* Educate the public about threats to private property and the quality of life represented by organizations that are successfully working to place Santa Cruz County water usage under the regionalized influence of non-elected administrators—while holding no accountability to county electorate, local or state laws, or the US Constitution.
* Publicize how similar policies in affect throughout the USA are causing economic devastation, loss of property, and loss of life.
* Promote an overhaul of the Environmental Species Act to consider human life, liberty, pursuit of happiness, and Constitutionally protected rights.

Kiwis fight German threats to manuka honey industry

Manuka honey producers are waging war on two fronts against Germans challenging their industry.
The UMF Honey Association has engaged law firm Buddle Finlay to fight one German who has registered the word "Manuka" as a trademark covering all of Europe.

At the same time, the association is battling another German seeking to patent a bee food which its inventor says will give the honey produced by the bees the exact chemical profile of manuka honey.

John Rawcliffe, general manager of the association, said both developments posed a threat to the manuka honey industry.

Manuka honey is extremely valuable and the industry could be worth $1 billion a year if it is able to maintain its credibility. Rawcliffe says the high value of manuka honey makes it a target internationally.

Already there is international counterfeiting, while locally a bitter fight has been waged over manuka honey labelling and standards.

The Commerce Commission has been gathering evidence on the designation systems to see whether any are misleading consumers. Retailers in Auckland were put on notice by the association last week that they can't simply rely on producers' labels as a defence against actions under the Fair Trading Act should the manuka honey they are selling not turn out to be the real deal.

The European trademark was being contested on the grounds that manuka is a generic, descriptive term, said Buddle Findlay lawyer John Glengarry, and he had high confidence of victory for the association.
Glengarry said if the trademark was allowed, the person who registered it "would have as a starting point the right to prevent others from using the word manuka as a trademark for honey".

This would include products to which manuka honey is added.

The Deutsches Patent und Markenamt database lists the "proprietor" as Mirko Zill. Rawcliffe said he could not be allowed to own a trademark to make money out of manuka honey producers of New Zealand.
The patent for the bee food, which has been submitted to the New Zealand Intellectual Property Office, was being opposed on the grounds that it was not inventive, said Glengarry.

Rawcliffe admitted that although he did not believe the technology was being used to fake manuka honey yet, or boost "inactive" manuka honey, its existence meant the threat would forever be there.

As well as the legal fees to fight the patent registration, which is in the name of German Daria Heuer, Rawcliffe said the association had spent around a quarter of a million dollars on having lab tests devised that could distinguish real manuka honey from honey produced using the bee feed.

They looked likely to be ready in two months' time, he said.

All up, the legal bill for the association would come to over half a million dollars.

Rawcliffe warned that honey was a food produced by bees using nectar from flowers, and that anyone caught selling honey that was made with additives without disclosing it would be breaking the law.

He said the association had turned down an offer to purchase the technology.

That the association was fighting its legal battles alone, with no help from the Government or from a number of manuka honey producers, was disappointing, Rawcliffe said, but "manuka is worth huge money".

 Key defends 'no' to Kyoto Protocol

The government is defending its decision not to commit to the second stage of the Kyoto Protocol on climate change, acknowledging the previous government "may have had a stronger emphasis" on the issue.
Climate Change Minister Tim Groser said on Friday the government would not sign up for the second commitment period of Kyoto, and will instead opt for the United Nation's Convention Framework, following the lead of major economies such as the United States, Japan, China, India, Canada, Brazil and Russia.
The government has since been criticised by Labour, the Greens and WWF, who say the decision leaves New Zealand's "clean and green" image in tatters, with Australia and European countries reaffirming their Kyoto commitment.
But Prime Minister John Key says the new convention will still see New Zealand name a binding commitment on climate change.
"We'll actually have a physical rate that we're going to hit ... We'll essentially be able to set our own rules outside [of the Kyoto Protocol]," Mr Key told TVNZ's Breakfast.
"New Zealand needs to play its part, it is playing its part - it's already got an Emissions Trading Scheme, we've made quite a number of other changes ... but I think we never want to be a world leader in climate change.
"We've always wanted to be what is affectionately called a `fast follower'."
Mr Key says the previous government may have had more of an emphasis on climate change, but his government wants to "make sure we're sensible in this area".
"What we do environmentally matters a great deal, but we also want jobs and we also want to make sure we're not prioritising that over everything else. I think we've got that balance about right."
Mr Key added that New Zealand wants to change some of the rules governing the Kyoto Protocol, including "around land use and things like that".

The G.O.P. platform approved Tuesday in Florida included tough language on many expected issues like abortion, but also takes a stand on an issue that has historically been out of the party’s mainstream: Agenda 21.
“We strongly reject the U.N. Agenda 21 as erosive of American sovereignty, and we oppose any form of U.N. Global Tax,” the platform reads.
Agenda 21 is a 1992 United Nations resolution that encourages sustainable development globally. Although it is nonbinding and has no force of law in the United States, it has increasingly become a point of passionate concern to a circle of Republican activists who argue that the resolution is part of a United Nations plot to deny Americans their property rights...Click to read More

Sustainable Development Chairman Banned from Papua New Guinea

 Australian climate change adviser and chairman of the OK Tedi mining company, Ross Garnaut, is no longer welcome in Papua New Guinea, after the prime minister accused him of insulting the nation's leaders.

Prime Minister Peter O'Neill told PNG's parliament Professor Garnaut, who until recently was also chairman of the PNG Sustainable Development Fund (PNGDF) trust, would not be allowed back until control of the mine was given back to the PNG people.

The trust was given ownership of the OK Tedi mine, located in PNG's Western province, by mining giant BHP.

"I will put (Prof Garnaut) on notice that he is no longer welcome to this country," Mr O'Neill told the house during a grievance debate on Friday.

"He can stay out of PNG and conduct himself. I want it out on record in this parliament that we will not tolerate people of such standing coming in and disrespecting leaders of this country."
Earlier, Mr O'Neill referred to a report in The Australian newspaper which quoted Prof Garnaut as saying that with such an accumulation of wealth in PNG, it was "tempting for political figures to think of better ways of using it right now rather than putting it into long-term development".

Mr O'Neill, who was elected in August on a platform of improving the nation's ailing infrastructure, said BHP was running the PNGSDF by remote control from Melbourne and questioned whether PNG had benefited from the project.

"Has it delivered to the expectations of our people, particularly the people of western province?" he said.
"What have they delivered? We have given them a blanket cover, blanket insurance, protection from this parliament that we will never sue them for the damage they have caused to our people.

"We have seen many big announcements about major projects that will change the course of this country over the past 10 years, and yet we have yet to see one of those projects being delivered."
PNG's former prime minister and finance minister Sir Mekere Morauta has been named as chairman of the PNGSDF, replacing Prof Garnaut.

Australia has effectively cut off access to more than 33% of its surrounding waters to demonstrate its submission to the United Nations' Agenda 21 and the Green Agenda just in time for the Rio+20 conference.
"It's time for the world to turn a corner on protection of our oceans," Mr Burke said. "And Australia today is leading that next step. 
"Australia has timed its announcement to coincide with the run-up to the Rio+20 Earth Summit - a global gathering of leaders from more than 130 nations to discuss protecting key parts of the environment, including the ocean, says the BBC's Duncan Kennedy.

But don't lament, because one of the industries that will suffer from this exclusion of access to the natural resources of Australia will be compensated by the Australian taxpayer. 
The fishing industry is set to receive hundreds of millions of dollars in compensation, reports say.
This appears to be a lose-lose situation for the citizens of Australia.  Their fishing industry takes a big hit, and then Australians have to compensate companies for the reduction of said industry.  Then, the reduction of the fishing industry will most likely have a negative impact on their overall national economy.
The fishing industry is Australia’s sixth most valuable food-based primary industry with a landed value of more than $2.1 billion a year.
